1. Acceptance of Terms

By downloading, accessing, or using the PawIQ mobile application ("App") and its related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and PawIQ ("Company," "we," "us," or "our").

2. IMPORTANT MEDICAL AND VETERINARY DISCLAIMER

THE SERVICE DOES NOT PROVIDE MEDICAL OR VETERINARY ADVICE.

2.1. Informational Purposes Only: The content, analysis, reports, and insights provided by PawIQ, including those generated by Artificial Intelligence (AI), are for informational and educational purposes only.

2.2. Not a Diagnostic Tool: The App is NOT a diagnostic tool, medical device, or a substitute for professional veterinary advice, diagnosis, or treatment. The AI analysis is based on visual patterns and data provided by you, which may be incomplete or misinterpreted by the system.

2.3. Consult a Professional: Always seek the advice of your veterinarian or other qualified animal health provider with any questions you may have regarding a medical condition. Never disregard professional veterinary advice or delay in seeking it because of something you have read or seen on this App.

2.4. Emergency Situations: If you think your pet has a medical emergency, call your veterinarian or your local animal emergency hospital immediately. PawIQ does not recommend or endorse any specific tests, veterinarians, products, procedures, opinions, or other information that may be mentioned on the Service.

2.5. No Doctor-Patient Relationship: Use of the App does not establish a veterinarian-client-patient relationship.

3. AI Technology Disclaimer

3.1. Accuracy Not Guaranteed: The Service utilizes advanced Artificial Intelligence and Machine Learning technologies to analyze images and data. While we strive for accuracy, AI technology is experimental and evolving. The Service may produce false positives, false negatives, "hallucinations" (plausible-sounding but incorrect information), or otherwise inaccurate results.

3.2. No Liability for AI Errors: We explicitly disclaim any liability for errors, omissions, or inaccuracies in the AI-generated analysis. You acknowledge that you are using the AI features at your own risk and that you will verify any information obtained from the App with a qualified professional before taking any action.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAWIQ, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST TWELVE (12) MONTHS, OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

5. User Responsibilities

5.1. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

6. Subscriptions and Payments

6.1. Premium Features: Some features of the Service may require a paid subscription ("Premium").

6.2. Billing: Subscriptions are billed in advance on a recurring basis. Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase.

6.3. Auto-Renewal: Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

6.4. Cancellations: You can manage and cancel your subscriptions by going to your Account Settings on the App Store or Google Play Store after purchase.

6.5. Refunds: Refunds are handled by the respective app store (Apple or Google) in accordance with their refund policies. We do not have the ability to process refunds directly.

7. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of PawIQ and its licensors. The Service is protected by copyright, trademark, and other laws.

8. Indemnification

You agree to defend, indemnify, and hold harmless PawIQ and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

9. Modifications to Service and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We may also modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Company is established, without regard to its conflict of law provisions.

12. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

12.1. Acknowledgement: These Terms are concluded between you and PawIQ only, and not with Apple, Inc. ("Apple"). PawIQ, not Apple, is solely responsible for the App and the content thereof.

12.2. Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded Products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

12.3. Maintenance and Support: PawIQ is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

12.4. Warranty: PawIQ is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

12.5. Product Claims: You acknowledge that PawIQ, not Apple, is responsible for addressing any claims of yours or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

12.6. Intellectual Property Rights: You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, PawIQ, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

12.7. Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

12.8. Third Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).

12.9. Third Party Beneficiary: You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms with respect to the App, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
